Terms of Use
These Terms of Use ("Terms") are an agreement between you and Techxant Technologies ("PhiFace", "we", "us") governing your use of the PhiFace mobile application and website. By downloading or using PhiFace you agree to these Terms. If you do not agree, please do not use the app.
1. What PhiFace is
PhiFace is an entertainment and educational tool that measures a small number of facial proportions from a photograph on your device and compares them with classical reference ratios derived from the golden ratio (Phi, approximately 1.618). The result is presented as a set of measurements and a simple summary number.
PhiFace is not a beauty rating, a medical device, or a diagnostic tool. It does not assess attractiveness, health, or fitness for any purpose, and it must not be used to make medical, cosmetic, surgical, employment, insurance, or any other consequential decision.
2. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use PhiFace on devices you own or control, for your own non-commercial use, in accordance with these Terms and with the rules of the app store you obtained it from.
3. Acceptable use
You agree not to:
- use PhiFace to measure or analyse another person's photograph without that person's knowledge and consent;
- use PhiFace to harass, demean, rank, bully, or discriminate against any person;
- present PhiFace output as a medical, psychological, or professional assessment;
- reverse engineer, decompile, or attempt to extract the source code or models of the app, except where this restriction is prohibited by applicable law;
- use the app in violation of any applicable law, including biometric and privacy laws in your jurisdiction.
4. Accuracy and limitations
Measurements are derived from a two-dimensional photograph and are inherently approximate. Camera distance, lens characteristics, head angle, lighting, expression, and facial hair can all change the values produced. Results may differ between photographs of the same person. We make no warranty that results are accurate, precise, repeatable, or suitable for any particular purpose.
5. Your content
Photographs you use remain yours. PhiFace processes them on your device and does not transmit them to us; we therefore never receive, store, or claim any rights in your images. You are responsible for having the right to use any photograph you analyse.
6. Intellectual property
The PhiFace name, logo, app design, and content are owned by us and protected by intellectual property laws. These Terms grant you no rights to our trademarks or branding.
7. Purchases
PhiFace's core measurement features are free. If optional paid features are offered in future, they will be sold through the Apple App Store or Google Play billing systems, and those stores' payment, subscription, and refund terms will apply to them.
8. Disclaimer of warranties
PhiFace is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
9. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of data, profits, or goodwill, arising from or related to your use of PhiFace. Where liability cannot be excluded, our total aggregate liability is limited to the greater of the amount you paid for the app in the preceding twelve months or USD 10. Nothing in these Terms limits liability that cannot lawfully be limited, and some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
10. Apple and Google
These Terms are between you and us, not with Apple Inc. or Google LLC. Those companies are not responsible for the app or its content, have no obligation to provide support for it, and are third-party beneficiaries of these Terms with the right to enforce them against you.
11. Termination
You may stop using PhiFace at any time by uninstalling it. We may suspend or discontinue the app, in whole or in part, at any time.
12. Changes
We may update these Terms. Material changes will be reflected by an updated effective date and, where appropriate, notice in the app. Continued use after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of Pakistan, without regard to conflict-of-law rules. Mandatory consumer-protection rights in your country of residence are unaffected.
